We love fun and games, but we know that privacy protection deserves serious attention. Just like in real life, you should have control over the information you share online and be able to change or delete it. Learn about your privacy rights and how to use them.

What are your privacy rights?

  • Privacy rights are there to protect you. They give you more control over your data.
  • You can decide what information a website saves and who is allowed to use it. This includes data not directly linked to your name but still traceable to you, like the games you’ve played on your device.

You can always ask what information we have about you. If you want, you can also ask us to delete your information or just keep it without using it anymore. If you think something is wrong with the information we have, you can ask us to fix it.

We don't use your information to create a profile or make decisions about you, but if we did, we would tell you. If you ever think we're not following the rules, you can tell the authorities (that's sort of the government). You can ask a grown-up to help you with this or ask us directly.

What privacy rights do you have?

  • The right to withdraw consent allows you to cancel the permission you gave us to use your information.
  • The right of access makes it easy to check what information we have about you, where we got it, how we use it, and who we share it with.
  • The right to rectification means you can ask us to fix any personal information that is wrong, incomplete, or not used properly.
  • The right to erasure is a very formal way of saying that we’ll delete your personal information if you want us to and if it’s no longer needed.
  • The right to data portability requires us to send you (or someone else) the information we have in a format most computers can read.
  • The automated decision-making prohibition means we may not only rely on software for decisions that could have a big impact on you. In such cases, we can involve a human to make the final call.
  • Some privacy rights only apply in specific situations. These are explained in the full text.

In relation to our processing of your personal data, you have the following privacy rights. You have the right to not be discriminated against for exercising these privacy rights. To what extent you can exercise these rights may depend on the circumstances of the processing. Such as the manner in which Poki processes the personal data and the legal ground for the processing.

In so far as our processing of your data is based on your consent, you have the right to withdraw your consent.

If we obtain consent in another context, please note the following. Withdrawal of consent does not influence the legitimacy of the processing before you withdrew your consent. If you withdraw your consent, Poki will no longer process your data for the purpose that you consented to. It can however be possible that we still process the personal data for another purpose, such as to comply with a minimum retention period. In that case you will be informed about this.

You have the right to request access to your data. This enables you to receive a copy of the data we hold about you (but not necessarily the documents themselves). We will then also provide you with further specifics of our processing of your personal data. For example, the purposes for which we process your data, where we got it from, and with whom we share it.

You have the right to request rectification of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected. You have this right in case we process personal data about you that: (i) is factually incorrect; (ii) is incomplete or not related to the purpose it was collected for; or (iii) is in any other way used in a manner that is in conflict with an applicable law. The right of rectification is not intended for the correction of professional opinions, findings or conclusions that you do not agree with. However, Poki could in such case consider adding your opinion about this to your data.

Since we mainly process technical data, we are often not able to rectify your personal data. If the computer recorded that you accessed our website at 15:12h CET, we cannot just change this in our records. If we are unable to rectify your data, we can offer you the option of deleting it instead.

You have the right to request erasure of your personal data. This enables you to ask us to delete or remove your data where: (i) the data is no longer necessary, (ii) you have withdrawn your consent, (iii) you have objected to the processing activities, (iv) the data has been unlawfully processed, (v) the data has to be erased on the basis of a legal requirement, or (vi) where the data has been collected in relation to the offer of information society services.

However, we do not have to honor your request to the extent that the processing is necessary: (i) for exercising the right of freedom of expression and information, (ii) for compliance with a legal obligation which requires processing, (iii) for reasons of public interest in the area of public health, (iv) for archiving purposes, or (v) for the establishment, exercise or defense of legal claims.

You have the right to request the transfer of your data in a structured, commonly used, machine-readable format to you or to a third party of your choice (right to data portability). Please note that this right only applies under specific circumstances. For example, if it concerns processing that is carried out by us by automated means, and only if our processing ground for such processing is your consent or the performance of a contract to which you are a party (see What data is used?).

You have the right not to be subject to a decision based solely on automated processing, which significantly impacts you ("which produces legal effects concerning you or similarly significantly affects you"). In this respect, please be informed that when processing your personal data, we do not make use of automated decision-making which significantly impacts you.

What rights apply in your country?

  • The right to object lets you ask us to stop using your information for marketing goals. In other cases, we’ll stop unless we have a strong reason to continue, like a legal requirement. If so, we’ll explain why.
  • The right to restrict processing means we will keep but can’t use your data. You can exercise it if you feel we have no valid reason to use your data or if your privacy request is still under review.
  • The right of complaint lets you file a complaint with a supervisory authority, for example in the country where you live, work, or where the issue occurred. The full text includes a link to a list of authorities, but please contact us first to see if we can resolve your issue.

How do privacy requests work?

  • If you want to use your privacy rights, you can e-mail or call us.
  • If you repeatedly make the same request or if it’s clearly unreasonable, we may not respond or charge a small fee for the extra work.

You can exercise your privacy rights free of charge, by phone or by e-mail via our contact details. If requests are manifestly unfounded or excessive, in particular because of the repetitive character, we will either charge you a reasonable fee or refuse to comply with the request.

Please note that if your request concerns data we obtained via cookies, you will also need to share certain cookie information with us. We need this data to determine which part of the data we hold, relates to you. No need to worry about how you will obtain this cookie information. If you contact us, we will inform you on how you can obtain and share the necessary information with us.

What happens after you make a privacy request?

  • We’ll respond to your privacy request as quickly as we can. If it takes longer than a month because it’s complicated or we’re handling many requests, we’ll keep you updated.
  • Our team can ask you to prove your identity. After all, it’s about your privacy, so we want to be absolutely sure we’re helping the right person.
  • Sometimes, privacy laws won’t allow us to handle certain requests. If that’s the case, we’ll explain why, unless we can’t legally share any details.
